Terms & Conditions

By purchasing a ticket and/or entering the premises of Wetherby Cinema, you agree to the following Terms and Conditions. Please read them carefully.

  • 1.1. “You” means any person who purchases a ticket or visits a cinema operated by Wetherby Film Theatre Ltd, whether or not they have purchased a ticket.

    1.2. “Us”, “We”, or “Our” means Wetherby Film Theatre Ltd and each cinema it operates, and includes any company in which Wetherby Film Theatre Ltd has an ownership interest.

  • 2.1. These Terms of Admission, as may be amended from time to time (the “Terms”), set out the general conditions that apply to all persons entering or using the premises, facilities, and services of Wetherby Cinema (“we”, “us”, or “our”). By purchasing a ticket, attending a screening, or entering the cinema, you agree to these Terms.

    2.2. Nothing in these Terms shall affect your statutory rights as a consumer under applicable law.

    2.3. We reserve the right to refuse admission or require you to leave the premises without a refund if you:

    • Violate these Terms;
    • Engage in disruptive, abusive, threatening, or unlawful behaviour;
    • Are under the influence of drugs or excessive alcohol; or
    • Attempt to enter age-restricted screenings without valid proof of age.

    2.4. Entry to the cinema is permitted only with a valid ticket for the specific film, date, time, and screen. We reserve the right to check tickets at any time and deny access to individuals without valid proof of purchase.

    2.5. Children under the age of 8 must be accompanied by an adult at all times while on the premises. It is the accompanying adult’s responsibility to ensure the child’s safety.

    2.6. Late arrivals may be refused entry once the screening has commenced.

    2.7. We reserve the right to make changes to film schedules, screening times, or advertised content due to circumstances beyond our control. Where this occurs and you have already purchased a ticket, we will offer an exchange or refund in line with our Ticket Refund Policy.

  • 3.1. Entry to films and events is restricted by the classification given by the British Board of Film Classification (BBFC) or other relevant authority. We are required to refuse admission to anyone who is below the minimum age required by the relevant classification.

    3.1.1. Anyone may be admitted to films classified as U or PG.

    3.1.2. Children under the age of 12 may be admitted to films classified as 12A, but only if accompanied by an adult (i.e. someone aged 18 or over).

    3.1.3. Nobody under the age of 15 may be admitted to films classified as 15.

    3.1.4. Nobody under the age of 18 may be admitted to films classified as 18.

    3.1.5. Children under the age of 10 must be accompanied by a parent or guardian for all films starting at or after 7.00 pm.

    3.1.6. Children under the age of 8 must be accompanied by a parent or guardian at all times.

    3.1.7. Child tickets are valid for children aged between 2 and 12 years inclusive.

    3.2. We reserve the right to require you to provide proof of age by means of valid photographic identification if you are attending a 12A, 15, or 18-rated film, or if you are purchasing an alcoholic beverage. If you are unable to provide acceptable proof of age when requested, you will not be permitted to view the film or purchase alcohol. We may request such identification at any time while you are on our premises.

    3.3. If you purchase a ticket before we know its classification and you are not old enough to be admitted to the screening, we will issue you with a full refund.

    3.4. “Full Refund” refers to the complete reimbursement of the ticket’s face value to the original payment method (e.g. card or cash). Booking fees may also be refunded at our discretion or where required by law.

  • 4.1. Baby & Me is a screening at our cinema which is exclusively for parents or carers with children under 12 months of age. Babies up to 12 months old attend free of charge.

    4.1.1. Adults without a baby will not be permitted to purchase a ticket for a Baby & Me screening.

    4.2. Kids’ Club is a regular screening at the cinema on Saturday and Sunday mornings for children of all ages.

    4.2.1. All adults must be accompanied by a child when attending a Kids’ Club screening. For the avoidance of doubt, “Adult” includes those purchasing an Adult, Senior, or Student ticket.

    4.2.2. All accompanying parents or guardians must remain in the cinema for the duration of the Kids’ Club screening and are solely responsible for their children at all times. It is the law that no child under the age of 8 may be left unattended in a cinema.

    4.2.3. All adults will be charged at the standard Kids’ Club ticket rate.

    4.2.4. A maximum of three children may attend per adult.

    4.2.5. No adult unaccompanied by a child will be admitted.

    4.2.6. Senior Screenings are screenings at our cinema which are exclusively for customers aged 60 and over to enjoy a film together with a complimentary cake and hot drink. Customers under the age of 60 are not permitted to attend these screenings.

  • 5.1. Only food and drink purchased on the cinema premises may be consumed inside the cinema. Outside food and beverages are not permitted.

    5.2. Alcoholic beverages may not be brought into the cinema building under any circumstances. If alcohol is brought into the cinema, staff may confiscate it until the end of the screening.

    5.3. You must comply with all licensing regulations relating to the sale and consumption of alcohol while on our premises. This includes, where advised, not taking non-toughened glassware into the auditoriums.

    5.4. Smoking is strictly prohibited anywhere inside the cinema, including all auditoriums, foyers, restrooms, and corridors. This prohibition extends to the use of electronic cigarettes (e-cigarettes), vapes, and other similar devices.

  • 6.1. Mobile phones must be switched off or set to silent mode before entering the auditorium. Making or receiving calls during the film is strictly prohibited.

    6.2. To avoid disrupting other guests, customers arriving after a film has started may not be admitted. In such cases, no refunds will be issued.

    6.3. It is a serious criminal offence to copy or attempt to copy any film or other copyright-protected material shown in the cinema. Offenders may face unlimited fines and/or imprisonment of up to ten years. The use of cameras or recording equipment of any kind within the cinema is strictly prohibited.

    6.4. Our published schedule may be subject to change at the discretion of the cinema.

    6.5. We endeavour to screen films as advertised. However, we may occasionally be unable to do so due to unforeseen circumstances. In such cases, our liability is limited to a full refund of the ticket price and any online booking fee charged by us. We accept no responsibility for programme information advertised by third parties.

    6.6. You must comply with all health and safety procedures or instructions issued by staff or displayed on signage throughout the cinema.

    6.7. We reserve the right to request proof of eligibility for concessionary tickets at any time while you are on our premises.

    6.8. Tickets must be purchased for personal use only. You warrant that tickets will not be purchased for resale or as part of any commercial activity unless we have granted prior written permission.

    6.9. We accept no responsibility for loss, theft, or damage to any personal belongings brought into the cinema.

    6.10. You must comply with the conditions of our licences as notified to you by our staff or by notices.

    6.11. Damage to Property and Injury

    6.11.1. While we take reasonable steps to maintain a safe and secure environment, you acknowledge and agree that Wetherby Cinema Ltd shall not be liable for any loss of or damage to your personal property while on the premises, unless such loss or damage is caused directly by our negligence.

    6.11.2. If you suffer injury or harm as a result of damaged property or unsafe conditions on our premises, you must report it to a member of staff immediately. Where such injury is proven to be caused by the negligence of Wetherby Cinema Ltd, we will comply with our legal obligations under applicable health and safety and consumer protection laws.

    6.11.3. You are responsible for any damage you cause to our property, whether intentional or accidental. We reserve the right to recover the cost of repair or replacement from you if damage occurs.

  • 7.1.1. If you wish to cancel, we can either exchange your tickets for another screening or issue a credit note for the ticket value, provided this is done at least 48 hours before the performance to allow us to resell the seats. Exchanges can be made by telephone on 01937 580544 or at the box office. Refunds are only available in person or over the phone to the original payment method and card used.

    7.1.2. We operate a 48-hour advance refund policy. However, where a fault on the part of Wetherby Cinema Ltd has affected your booking, a refund or complimentary ticket may be offered up until the time of the performance at our discretion.

    7.1.3. The online booking fee will only be refunded where the refund is due to a confirmed error in the ticket booking or payment processing that is directly the fault of Wetherby Cinema Ltd. Booking fees will not be refunded in any other circumstances.

    7.1.4. Premium-priced event tickets (e.g. event cinema or live broadcasts) may only be refunded up to 24 hours before the day of the performance. After this time, refunds may be issued only at the discretion of the duty supervisor.

    7.1.5. You acknowledge that the cancellation rights provided under the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to advance sales of cinema tickets.

  • 8.1. For the safety and security of our customers, staff, and premises, we operate a CCTV surveillance system throughout the cinema, including in public areas such as foyers, screens, corridors, and entrances/exits. CCTV footage may be monitored and recorded.

    8.2. Recordings may be used for the purposes of crime prevention, public safety, and ensuring compliance with these Terms and Conditions.

    8.3. Footage may be shared with law enforcement or regulatory authorities where required by law, or for the investigation of suspected criminal activity.

    8.4. By entering the cinema premises, you consent to being recorded for these purposes.

  • 9.1. The terms in this section (“Website Terms”) set out the legally binding terms which apply to everyone who accesses or uses the Website.

    9.2. By accessing or using the Website, you agree to be bound by these Website Terms. If you do not wish to be bound by these Website Terms, you must leave the Website immediately or not enter it at all.

    9.3. The Website is provided free of charge, and we make no guarantee that it will be uninterrupted or error-free. In addition, we reserve the right to modify or discontinue, temporarily or permanently, all or any part of the Website without notice and without liability.

    9.4. The Website and the materials on it are protected by copyright, trade mark, and other intellectual property rights and laws throughout the world. The materials on the Website are owned by or licensed to us and may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without our consent. Modification of the materials or use of the materials for any other purposes is a violation of copyright and other proprietary rights.

    9.5. The Website may contain links to other websites which are not controlled by us. The fact that we may provide a link to any such website does not mean that we endorse that website. Such links are provided for your convenience only, and you access them at your own risk.

  • 10.1. Tickets for films and events at our cinemas are sold by us at the prices displayed for the relevant performance, and the amount payable will be debited immediately from your credit or debit card.

    10.2. By requesting tickets through the Website, you are placing a booking request which is only accepted and binding on us once your card has been debited.

    10.3. A confirmation booking reference will be displayed on your screen and emailed to you.

    10.4. A Booking Fee will be charged per ticket and will be payable separately by you to Wetherby Film Theatre Ltd. The Booking Fee is required to cover online and website costs. By confirming your booking, you agree to pay this Booking Fee in addition to the price of your cinema ticket.

    10.5. The email confirmation of your booking will set out the details of the tickets purchased and the total amounts paid for your tickets and Booking Fee. Once this confirmation has been sent, the ticket price may be refunded only in accordance with Clause 7. Once a booking is confirmed, the Booking Fee is non-refundable.

    10.6. In the case of tickets being offered for sale at the wrong price online (i.e. at a higher or lower price than is applicable at the box office), we reserve the right to require that the tickets are refunded and the correct price charged. In these circumstances, the Booking Fee will only be levied once by Wetherby Film Theatre Ltd.

    10.7. If you have opted not to receive an email ticket, you may collect your tickets from any point of sale in the cinema at any time from when the booking is made until the start of the performance.

    10.8. You will need to bring either the card used for payment or your booking reference to collect your tickets.

    10.9. Concessionary and children’s tickets are offered for sale on the Website. In accordance with our General Terms, you must bring proof of status or age with you to the cinema to collect the tickets and gain admission to the performance.

    10.10. Bookings made on the Website are encrypted for security. However, you acknowledge that the Internet is not entirely secure and, whilst we and Wetherby Film Theatre Ltd will take reasonable steps to safeguard the security of any card information you provide, we shall not be liable for any damage you may suffer as a result of the loss of confidentiality of such information.

    10.11. You acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer.

    10.12. Loyalty scheme participants must enter their details at the time of purchase to claim any discount. It is not possible to amend the booking once it has been completed.

    10.13. Transactions will appear on your card or bank statement as a payment to Wetherby Film Theatre Ltd.

  • 12.1. This agreement shall be governed by, construed, and enforced in accordance with the laws of England. Any action brought to enforce this agreement shall be brought only in the courts of England, and you expressly consent to the jurisdiction of those courts. If any provision of this agreement is unlawful, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

  • 13.1. Please note our food is produced in areas that handle nuts, so our snacks are not suitable for people with severe nut allergies.

    13.2. Nuts are served from the bar alongside other products that contain nuts, and nut particulates may exist in seating and general customer areas.

    13.3. We cannot accept responsibility for any severe reaction to ingredients within food or drink we supply, or food or drink brought in by other customers to the cinema. Anyone with such severe allergies attends the cinema entirely at their own risk.

    13.4. We do provide gluten-free cakes for those with gluten intolerances; please ask on arrival.

     

  • 14.1. A group booking is classified as “large” when it includes more than six tickets.

    14.2. Private hire of the cinema (the “Venue”) is subject to a separate agreement between the hirer and Wetherby Cinema Ltd, incorporating these Terms and Conditions and any specific terms outlined in the hire agreement or booking confirmation.

    14.3. A booking is only confirmed once a hire agreement is signed and the required deposit or full payment has been received. We reserve the right to cancel unconfirmed bookings without notice.

    14.4. The hirer is responsible for:

    • ensuring the event does not exceed the agreed number of guests;
    • maintaining appropriate conduct of all attendees;
    • ensuring no damage is caused to the premises, equipment, or fixtures;
    • leaving the space in a clean and tidy condition;
    • ensuring no outside food, drink, or alcohol is brought into the cinema unless explicitly authorised in writing as part of the hire agreement.

    The hirer assumes full responsibility for any loss, damage, or injury arising during the hire period, except where caused by the proven negligence of Wetherby Cinema Ltd or its staff.

    We reserve the right to cancel or terminate any private hire event without refund if guests:

    • breach any of these Terms and Conditions;
    • engage in antisocial, abusive, or illegal behaviour; or
    • pose a risk to health and safety, property, or staff.

    14.3.1. In the event of cancellation by the hirer, refunds (if any) will be issued according to the terms set out in the hire agreement. Deposits may be non-refundable.

    14.3.2. Any films or content shown during a private hire event must comply with UK classification and licensing laws. It is the hirer’s responsibility to obtain any necessary permissions or licences for privately supplied media.

  • 15.1 Private hire and parties are not offered.

    15.2 Large group bookings are welcome; children’s groups require adequate adult supervision (minimum 1 adult per 4 children recommended).

    15.3 No private seating areas are available in public spaces.

    15.4 Large groups (6+) ordering hot food should arrive 30 minutes early. Food service cannot be guaranteed for late orders.

  • 16.1 Food may contain or be prepared in environments handling nuts.

    16.2 Nut particles may be present in public areas.

    16.3 We cannot guarantee allergen-free environments and accept no liability for severe allergic reactions.

    16.4 Gluten-free options are available on request.

  • 17.1 Tickets show allocated screen (Screen 1 or 2).

    17.2 Please check your ticket before entry.

    17.3 You may be asked to move if in the wrong screen.
